Trial by jury has no place in modern Britain - Essay Example The system of jury trial has been related to the common law. In fact, Norman kings have promoted the specific process sending their judges ‘to preside at jury trials’ (Spooner 2006, p.88). In the above context, the objectivity of the court was ensured through the following practice: the public could choose ‘four people to sit with them’ (Spooner 2006, p.88). Magna Carta has enforced the specific rule in order to ensure that judge will not influence the jury (Spooner 2006). Saxons did not accept the interference of king’s judges with the jury, aiming to keep the court independence from the ruling of the king (Spooner 2006). Today, a similar approach can be used for justifying the non-appropriateness of jury trial in English law. Due to its structure, the English legal system ensures the objectivity in trial, at least at higher level than other legal systems worldwide where the use of jury in trials often causes severe problems in the court procedure. The presence of juries in trial has been, traditionally, considered as a measure for ensuring equality in terms of law, i.e. to ensure that the decision of the court will be fair both for the perpetrator and the public, meaning that no punishment will be imposed unless the person considered as the perpetrator has, indeed, committed the offense involved. It is for this reason that in trial with juries the defendant is given plenty of time in order to present all the evidence available; in this way it is ensured that the crime will be fairly and appropriately evaluated by the jury. In practice, the participation of juries in trials has led to ‘verdicts, which have protected the personal rights’ (Hosterttler 2004, p.155). However, it cannot be stated that trial by jury always lead to the correct verdict or that juries ‘protect the law’ (Hosterttler 2004, p.155). Such perception cannot be acceptable taking into consideration the involvement of other individuals in critical parts of each trial, especially the judge in directing the trial and the lawyers in presenting/ analyzing the evidence involved. From this point of view it could be noted that juries are not indispensable part of criminal law. In the English legal system this view could be also applied, especially since in the particular system, due to its structure and its principles is quite difficult to lead to failures in regard to the evaluation of evidence, minimizing the risks for wrong verdicts. Currently, criminal trials in the English legal system are based on the trial jury, but not necessarily. In minor offences, these that are heard before the magistrate’s courts, the offender has the right to choose between ‘a trial before the magistrate court and a trial by jury before the Crown Court’ (Erastus-Obilo 2009, p.41). On the other hand, in more serious offences, the offender does not have such option. The trial is heard necessarily ‘by judge and the ju ry’ (Erastus – Obilo 2009, p.41). Moreover, the power of jury as factors determining the cases cannot be ignored. In fact, the verdict cannot replace the judgment of the court, but the verdict is the basis for the development of the judgment. Bowling for Columbine Is Not a Documentary Essay Example for Free

Bowling for Columbine Is Not a Documentary Essay Michael Moore’s ‘Bowling for Columbine’, the film which won an Oscar for best documentary, is not in fact a documentary, but rather more of a persuasive essay in film format. The widely accepted definition of ‘documentary’ is a film emphasizing or expressing things as perceived without distortion of personal feelings, insertion of fictional matter, and minimal editting, and ‘Bowling for Columbine’ does not show any of these characteristics. Instead of presenting a neutral view of the issues, it is clearly biased and purposely manipulates the viewers into agreeing with Moore’s opinions. In the process, Moore frequently uses incorrect statistics and information. In some cases fabricated evidence is also inserted. Documentaries should have close to no editing of the evidence, however in some cases Moore uses sly editing techniques to deceive the viewers. A prominent example of this can be seen in Charlton Heston’s speech. It appears as though the NRA president is holding protest rallies in response to the gun related incidents in Columbine and Flint Michigan, holding a musket up and proclaiming â€Å"I have only five words for you: ‘from my cold dead hands’† whilst the crowd cheers. Moore makes a point of cutting from scenes of heartbroken victims to Heston’s ‘arrogant’ speeches. The purpose of this is to demonize Heston, and also all the members of the NRA. He wants the audience to perceive all gun lovers as heartless, selfish monsters. However on closer observation, it turns out Moore simply grabbed segments from Heston’s former speeches, splicing them together to form a new one, completely different from what the president had intended. Documentaries are meant to lay out the truth, whilst here the film has morphed the truth into a lie instead. Going back to the definition, Bowling for Columbine again falls short of being a documentary through it’s failure to include only correct, factual evidence. Moore chooses to use incorrect ‘facts’; the national gun murder statistics that seem abnormally high are sourced from the National Centre for Disease Prevention and Control, and is a combination of gun related and non gun related incidents, so is therefore irrelevant to what the documentary was trying to say. The rockets shown in the Lockheed Martin sequences and being driven though the streets of Littleton in the night are in fact space launch vehicles, not weapons of mass destruction as Moore claims. These facts, false in nature, are again put there to distort the truth and make the viewers believe that things are more horrifying than they actually are, so that they are more susceptible to Moore’s mental manipulation. One of the fundamentals of a documentary is that it must present facts, and obviously â€Å"Bowling for Columbine† has not fulfilled that requirement. Throughout â€Å"Bowling for Columbine†, Moore presents an extremely biased view of events. Moore does everything in his power to manipulate viewers into see things from his eyes. Many are many persuasive techniques are used to achieve this. The film horrifies the audience with confronting scenes from the 9/11 attacks and the Columbine shooting. ‘A Brief History of America’ makes people see Americans as cowardly and pathetic. Charlton Heston’s ‘speech’ angers the audience and makes them turn against gun lovers. There are many more examples, however the point is that documentaries should be neutral and informative, yet the film actively tries to force the viewers to a narrow-minded conclusion. In summary, although â€Å"Bowling for Columbine† may be a creative persuasive film, it is most certainly not a documentary. Not only does the film fail to adhere in any way to the definition of a traditional documentary, it largely utilises deceptive techniques to push Moore’s artificial and contrived point of view.

  Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  Bulimia Nervosa [also known as Bulimia] is a very serious and dangerous eating disorder. The disorder can be describe as bingeing and then followed by purging or a person who eats a large amount of food in short periods of time and then vomits after eating to prevent on gaining the weight cause by the food. There is different ways of going about ways to prevent the weight gain, making oneself throw up, taking pills, or laxatives which will increase how fast the food will move through your body, exercising excessively, eating a little amount or not at all, or taking other pills to pass urine This disorder is mostly between the ages of 15 and 35, even if they have no specific food disorders. Studies made in Europe and USA have underlined the fact that roughly 10% of women in this age bracket say they and provoke vomiting occasionally 2% vomit once or more per week. This disorder is most commonly found in girls and in their late teen years, but that’s not to s ay it does not happen to boys it does but it is very rare. With a person who has bulimia it is very hard to tell by their appearance because when you have Bulimia you look average weight or just below it.   Ã‚  Ã‚  Ã‚  Ã‚  This disorder is split up into 3 different illnesses they all have a lot in common but also have differences. The first type is Simple, simple bulimia nervosa usually affects girls at age 18 years old. The cause for this illness is under confident about oneself but come from good backgrounds. This illness is usually triggered by a short time of depression, such as a break up with a boyfriend. The girls who have simple bulimia nervosa have had a normal life as made friends normally and then they will have the short depression period and they will learn to hate themselves and their appearance. Usually diets start to boost up ones self esteem and then they cheat during the diet and vomiting will occur after eating. This form of bulimia is the least out of all 3 forms severe. But that is not to say that the girls who do this don’t progress into worst conditions. Another form of the disorder is Anorexic Bulimia Nervosa this is almost a mixture between Anorexic a nd Bulimia. It starts off as just a brief period of anorexic and then when that is over the sufferer recovers the illness by a short period of stabilized weight... ... and mental health professionals come in to help the patient recover. In different cases of the disorder family therapy is the best way to help overcome the disorder and helps eat healthy again. The family has a big effect on the sufferer and has to help the person realize that there body shape if perfectly fine and doesn’t need to be thin to make anyone happy. There is always Clinics that may help treat the disorder, the treatment is structured and controlled so that they have to eat in a better and healthier way. If there is no desire and hospitalizing is not necessary for the sufferer then there is the choice of outpatients by having weekly visits to a therapist and sometimes needs psychotherapy for the medicine, which can be more effective in worst cases. These disorders should not be left alone or untreated they can damage the body and soul and if left untreated the disorder can kill and at the best leave you looking terrible and feeling worse. These disorders may hel p you lose weight or not let you gain any, but in the long run it can seriously harm one and not only do these disorders affect the sufferer it also affects the people around them.   Ã‚  Ã‚  Ã‚  Ã‚

And at least one-third of all fathers or mothers who had ADHD in their youth have children with ADHD.Studies show that children with ADHD tend to have abnormal functioning, or dysregulation, of certain brain chemicals known as neurotransmitters. There also tends to be abnormal functioning in the nerve pathways that regulate behavior. In addition, children with ADHD may have certain parts of the brain that are smaller or less active than they are in children who don't have ADHD. Recent studies show that the brain chemical, dopamine, may play a role in ADHD. Dopamine is an important chemical that carries signals between nerves in the brain.It is linked to many functions, including movement, sleep, mood, attention, and learning. Since the end of the Civil War and the abolition of slavery in 1865, the United States did not progress positively as a society. One would think that this country’s society would have progressed greatly in a positive direction since slavery’s abolition, but the opposite is true. The radical changes that happened in the United States following the Civil War were primarily detrimental citizens and society as a whole. With issues like segregation and racism entering new eras, many new problems began to arise. Separate but equal laws, organized hate groups, and racist ideals fueled the fire that began with installment of the 13th Amendment. After Plessy vs Ferguson in 1896, the installment of separate but equal laws became the standard in the United States. With the installment of these laws in the United States, all public services were supposed to be equal for both races. But these hardly regulated laws only highlighted the differences in service quality received between the races. The separate, secondary accommodations that were provided for blacks were not up to par to the services received by the whites. Separate but equal laws not only separated whites and blacks physically, but these laws made it possible for blacks and whites to coexist entirely separately. Michael Alster Any American would be hard-pressed to turn on the news and not find something, anything, said about Operation Iraqi Freedom. The war in Iraq is one of the most publicized (and controversial) topics so far of the 21st century. Unfortunately, a common headline reads something like this: â€Å"5 Marines killed in Baghdad Today,† â€Å"15 American troops injured in a suicide bomb attack in Tikrit this morning.† What about the casualties that aren’t reported on the news? The troops that suffer - not from physical wounds that can heal, be stitched up, or adapted to live with – but from non-visible scars. Mental injuries are becoming increasingly common among today’s decorated war heroes. Many are too embarrassed, scared or†¦show more content†¦It starts out slowly as a dream, perhaps, or as a daydream, and escalates into depression, insomnia, anxiety, alienation and rage. It is thought that stress increases someone’s chance of dev eloping PTSD after a traumatic event. Therefore, to reduce the risk of the disorder, there is a need to reduce the stress and increase training so that soldiers know what to expect, how to handle it when it occurs, and what to do when they can’t handle it. It is agreed across the board that the United States Military provides prevention training to its soldiers. Each branch of the military is supposed to provide this training to each of its soldiers before, during, and after their deployment. This can be as important as teaching a new soldier how to clean his gun. Sometimes though, factors like timing and money dictate if the training is actually administered, and mental health training may be the first to go. Also, the military provides soldiers with a variety of mental health services. A search of the army medicine website, armymedicine.army.mil, reveals news on mental health and a link to the army’s behavioral health website. Information about the various services the Department of Defense offers are scattered over several websites. Again, Operation Iraqi Freedom’s budget limits the availability and accessibility of these services. Unless a soldier requests help, it’s usually not offered. Many soldiers ask, â€Å"Why me? Why not the guy next to me?
